oh nan le site est plus là, moi qui voulait encore télécharger quelques uns de leur morceaux pour faire ecouter a un pote, c'est trop tard maintenant

Comme je l'ai écrit dans ma signature, l'action de Sony indique quand se situe la fin de la démocratie : MAINTENANT !!!!

Donc pour vraiment faire chier, on s'installe mumule, et on envoie ses fichiers !

Et si y'en a, on achète les disques (mais bon ce serait illogique de faire fermer le site et de laisser les disques en vente libre), de plus, autant les voler, la peine pour vol de skeud est moins importante que celle du télech' (oui j'exagère un peu mais ce courant de neo-fascisme liberal me donne constament envie de gerber)

BEATALLICA, the Internet sensation who combine the work of THE BEATLES with the sound of early METALLICA, have had their web site taken down by their ISP (Internet Service Provider) in connection with the recent "cease-and-desist" order that was sent to BEATALLICA's ISP courtesy of Sony/ATV Music Publishing (who own the rights to much of THE BEATLES' catalog). The web site will reportedly be down for at least the next 10 business days until BEATALLICA's counter-claim goes through. In addition, BEATALLICA's web site administrator has received a cease-and-desist notice that was similar to the one received by the group's ISP (ThePlanet.com) except that the new document includes a request for all hard and electronic copies of any music as well as an accounting of all sums received or earned in connection with the material.

Sony/ATV's order included a list of 17 BEATLES tunes that it claims the band has used without permission, including hits like "A Hard Day's Night" and "Ticket to Ride", as well as deeper album tracks like "Run for Your Life" and "Everybody's Got Something to Hide Except Me and My Monkey", according to OnMilwaukee.com.

The band and ThePlanet.com had complied by removing the content on its web site Beatallica.org and replacing it with a petition that it plans to forward to Sony Music.

Well over 2,000 people have already signed the petition, which was launched by U.K.-based BEATALLICA fan Sam Harris and asks, "We, the undersigned, request that Sony Music retract the cease-and-desist order placed on www.beatallica.org and www.beatallica.com and recognize the music of BEATALLICA as parody, which is legal in American law."

One fan who has made his support clear is METALLICA's Lars Ulrich.

"Yes, Lars Ulrich from METALLICA called me at home and we talked about the situation," BEATALLICA frontman Jaymz Lennfield (aka Michael "Tinker" Tierney) told OnMilwaukee.com. "He was very cool and the whole band has been extremely supportive. They're looking into how to best help us with the situation and any future situations. (DREAM THEATER drummer) Mike Portnoy started a forum on his site, too."

Lennfield says the actions aren't affecting the band's current status as a live act, and it isn't slowing down out of fear or cautiousness.

"In no way does all this crap affect live shows," he told OnMilwaukee.com. "We'll be bashing them out very soon. We look forward to 2005 as a fun year for us. We have a new tune ready to go; it's done and waiting for a secure home. We have material just waiting to be fleshed out and recorded for a follow up to 'The Gray Album'."

Oui mais en même temps pour des artistes qui vendent leurs albums (ce qui n'est pas le cas de Beatallica) ça fait quand même chier parceque il n'y a beau y avoir qu'une infime partie du prix que tu paye qui leur reviens, en telechargent ou en volant ben du coup ils gagne encore moins que ce petit truc qui étais déja pas grand chose ^^

Regarde Beatallica, ils sont connus seulement par le net et si tu vois le nombre de signatures sur la pétition, tu comprends que si ils se mettaient à vendre des albums, tous ceux qui en avaient téléchargé et avaient adoré le concept l'achèteraient.

Y'a un chef d'éditions de bouquins qui disait que ses livres étaient disponibles sur son site. Pour justifier cela il disait un truc très intéressant :

- Si tu télécharges et que ça te plais, tu peux acheter

- Si t'achètes pas tu peux l'offrir (pas très cool d'offir un paquet de feuilles du coup tu l'achètes) ou le conseiller

- Si t'aimes pas, tu l'auras pas acheté et tout le monde est content

Je pense que pour les disques c'est pareil : Tu te verrais offrir un cd gravé à quelqu'un ?

Wow bientot Beatallica vont ouvrir pour Metallica avec Lars et James si enthousiastes

According to BoingBoing.net, Lars Ulrich has asked Metallica's longtime attorney Peter Paterno to try and defuse the situation between Beatallica — the Milwaukee-based parody band known for Metallica-infused covers of Beatles songs — and Sony Music. As previously reported, Sony Music accused Beatallica of violating copyright laws, demanded that their webmaster pay "unspecified damages," and forced the band's ISP to shut down their web site.

Thanks to Ulrich's efforts, Beatallica will soon be back online, and the legal debacle over. Sony is now indicating that it may agree to just drop the case, if they even had a proper case in the first place.

Michael Tierney of Beatallica spoke to MTV.com about receiving help from Lars in their dispute with the Sony Corporation over Beatallica's "unlawful use" of the group's compositions "without authorization or license."

"Both of us want this to officially be over," Tierney told MTV.com. "Our legal team, with the help of Lars and his lawyers, have been in contact with the Sony folks and we're in the process of making sure everything's square." Tierney, 35, an occupational therapist by day, said he was pleasantly surprised when Ulrich called him a few weeks ago. "Metallica have been following what we've been up to for the past year and they've talked about us in a few magazine interviews and I got word three weeks ago that Lars wanted to contact us to talk," said Tierney. "He called me at home and we had several conversations about it and he said what he'd be willing to do for moral support and also as far as being more active in the situation. What really impressed me was that he was calling from his vacation with his family in Colorado. Nobody of his stature needs to take time out from their vacation to do that."

"The Internet is a swamp of piracy, so you send out cease-and-desist letters all the time," Metallica lawyer Peter Paterno said. "Someone at Sony probably saw this site and sent out a letter and once they realized what was on it they decided it was not something worth picking a fight over. They got that this is different from someone selling Beatles CDs and not paying royalties."
